I had the privilege this past Tuesday of debating the merits of Halbig and King with Jonathan Adler, a law professor at Case Western and one of the architects of the exchange litigation. The debate was a hoot—Jonathan is a wonderful sparring partner and an effective advocate—and I think we managed to present strong versions of both the challengers’ and the government’s arguments.

Sebelius, where an Oklahoma district court invalidated the IRS rule, I encourage you to check out Jonathan Cohn’s and Adrianna McIntyre’s excellent articles. I don’t have anything to add, except to say that it was cool to see one of my TIE posts make a cameo in the court’s decision [link no longer works], even if it didn’t persuade the judge.
